  • Abstract: From both an internal and ­comparative point of view, it seems from now on possible to qualify the Federal Constitutional Court of Germany of natural protector of the institutional interests of the Bundestag. Taking support on the principle of separation of powers, the Federal Constitutional Court of Germany interprets widely the rights of the Parliament in front of Government, as well as regards the legislative function of the Bundestag as its function of parliamentary ­control. Basing itself on the principle of democracy, it takes, in a very often unexpected and unequalled way, the defense of the Bundestag in front of the European Union.

    Das Bundesverfassungsgericht scheint nunmehr in doppelter Hinsicht, intern und komparativ, als natürlicher Beschützer der institutionellen Interessen des Bundestags bezeichnet werden zu können. Aufbauend auf dem Prinzip der Gewaltenteilung legt es die Rechte des Parlaments gegenüber der Regierung sowohl bei der Gesetzgebungsfunktion des Bundestags als auch bei der Funktion parlamentarischer Kontrolle weitläufg aus. Gestützt durch das Demokratieprinzip übernimmt das Bundesverfassungsgericht recht häufg unerwartet und in unerreichter Weise die Verteidigung des Bundestags gegenüber der Europäischen Union.
